Data protection

Thank you for your interest in our group of companies. Data protection is important to us and accordingly we will explain to you in this data protection declaration how we process which personal data (in short: "personal data", i.e. data relating to a specific or identifiable person, such as name, address, nationality, e-mail address , interests and hobbies, user behavior on websites) and process them. This data protection declaration is based on the EU General Data Protection Regulation (“GDPR” for short).

Collection of personal data and purposes of processing

(1) We primarily limit the processing of personal data to personal data that we receive in connection with our services and products from our customers, our cooperation partners or other persons involved or that we collect from users on our websites, apps or other applications.

(2) In particular, we collect the following personal data from you on a case-by-case basis and depending on the purpose (see below):

(3) In addition, we obtain and process, if permitted and indicated, case-specific further data from publicly accessible sources (e.g. land register, commercial register, media, Internet, Worldcheck) or receive such data from other group companies, from authorities and institutions, from your personal environment such as family, legal advisors) or other third parties.

(4) We need this data in particular to fulfill the following purposes:

 

  • to identify you as a customer, cooperation partner or user of our websites

  • to correspond with you

  • to carry out our due diligence obligations

  • to comply with other legal requirements

  • for the conclusion and processing of service contracts, e.g. founding order, mandate agreement, license agreement

  • for the conclusion and processing of purchase and sale contracts, e.g. for the purchase of products from suppliers or sales to interested parties

  • to provide other services from our company or, where appropriate, in cooperation with third parties

  • to provide you with the best possible and tailor-made services and to further develop our range of services and products

(5) We only process your personal data if we have a legal or contractual basis or the data processing is necessary for the performance of a task that is in the public interest or in the exercise of official authority. We only process data beyond this if we have your consent and there is no revocation. Or if a legitimate interest on our part prevails (e.g. continuation of the delivery of newsletters to existing customers, provided there is no revocation). Consent can be revoked at any time.

Recipients of personal data and data transfer abroad

(1) We only pass on your personal data to recipients or third parties within the scope of the purposes described above, insofar as this is permitted and indicated. This can include in particular:

 

  • group company

  • Service companies such as banks, asset management companies, insurance companies, IT providers, printers

  • customers on our part

  • Suppliers, dealers, transport companies, subcontractors or other cooperation partners

  • Authorities, state institutions, courts

  • Associations, institutions of public interest

 

(2) Such data transfer is based either on a legal obligation (e.g. data transmission in the course of the automatic exchange of information), a fulfillment of a contract (e.g. asset manager abroad), your consent, a public interest or on the basis of a legitimate interest on our part, unless the interests or fundamental rights and freedoms on your part with regard to the protection of personal data prevail.

(3) The recipients can be in Germany or abroad. In particular, we would like to point out that we can exchange personal data within our group companies or transfer personal data to countries in which service companies from which we obtain services (e.g. Microsoft, Thomson Reuters) are based.

 

In the case of recipients outside our company in the EU/EEA area or in countries with recognized data protection adequacy (e.g. Switzerland), we ensure data protection by concluding so-called order data processing agreements - if necessary and appropriate.

 

If we transfer personal data to third countries without appropriate legal data protection, we ensure an appropriate level of protection in accordance with legal requirements, for example on the basis of EU standard contractual clauses or other instruments (e.g. Binding Corporate Rules, US Privacy Shield).

Use of our website(s)

In addition to the above statements, we inform you about the use of our websites regarding the use of cookies, analytics/tracking or other technologies as follows:

(1) If you only use the website for informational purposes (i.e. if you do not log in to use the website, register or otherwise provide us with information), we do not collect any personal data, with the exception of the data that your browser transmits to enable you to visit the website enable the website, which may include the following data in particular:

  • Time zone difference to Greenwich Mean Time (GMT)

  • Content of the request (specific page)

(2) Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser. The cookies do no harm.

 

We only use them to make our offer more user-friendly. Some cookies remain stored on your end device until you delete them. They enable us to recognize your browser on your next visit.

 

If you do not want this, you can set up your browser so that it informs you about the setting of cookies and you only allow this in individual cases. However, we would like to point out that in this case you may not be able to use all the functions of our website to their full extent.

(3) We use Google Analytics on our websites. Google Analytics is a web analysis service provided by Google Inc. in the USA and uses cookies. Web analysis means the collection, collection and evaluation of data about the behavior of visitors to websites. A web analysis service collects, among other things, data about the website from which a person concerned came to a website, which subpages of the website were accessed or how often and for how long a subpage was viewed. A web analysis is mainly used to optimize a website and for the cost-benefit analysis of internet advertising.

 

The purpose of Google Analytics is to analyze the flow of visitors to our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our website and to provide other services related to the use of our website. Google can combine your behavior with other websites you visit. If you are a registered customer of Google, Google will recognize you accordingly. The data protection regulations of Google then apply to the further processing of personal data. Cookies are used to store personal information, such as access time, the location from which access was made and the frequency of visits to our website by the person concerned. Each time you visit our website, this personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the USA. Google may pass on this personal data collected via the technical process to third parties.

 

The person concerned can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used can also prevent Google from setting a cookie on your device (e.g. computer, notebook, tablet). In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.

(4) We use Google AdWords on our websites. Google AdWords is an internet advertising service that allows advertisers to place ads in both Google's search engine results and the Google advertising network. Google AdWords allows an advertiser to pre-define certain keywords that will be used to display an ad in Google's search engine results only when the user uses the search engine to retrieve a keyword-related search result. In the Google advertising network, the ads are distributed to topic-relevant websites using an automatic algorithm and taking into account the previously defined keywords.

 

The purpose of Google AdWords is to promote our website by displaying interest-based advertising on the websites of third-party companies and in the search engine results of the Google search engine and displaying third-party advertising on our website.

 

If a person concerned reaches our website via a Google ad, a so-called conversion cookie is stored on the information technology system of the person concerned by Google. What cookies are has already been explained above. A conversion cookie loses its validity after thirty days and is not used to identify the person concerned. If the cookie has not yet expired, the conversion cookie is used to determine whether certain sub-pages, such as the shopping cart from an online shop system, were accessed on our website. The conversion cookie enables both us and Google to understand whether a person who came to our website via an AdWords ad generated revenue, i.e. completed or canceled a purchase.

 

The data and information collected through the use of the conversion cookie are used by Google to create visit statistics for our website. In turn, we use these visit statistics to determine the total number of users who were referred to us via AdWords ads, i.e. to determine the success or failure of the respective AdWords ad and to optimize our AdWords ads for the future . Neither our company nor other Google AdWords advertisers receive information from Google that could be used to identify the data subject.

 

The conversion cookie is used to store personal information, such as the website visited by the person concerned. Accordingly, each time you visit our website, personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass on this personal data collected via the technical process to third parties.

 

The person concerned can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used can also prevent Google from setting a cookie on your device (e.g. computer, notebook, tablet). In addition, a cookie already set by Google AdWords can be deleted at any time via the Internet browser or other software programs.

 

Furthermore, the data subject has the option of objecting to interest-based advertising by Google. To do this, the person concerned must call up the link www.google.de/settings/ads from each of the Internet browsers they use and make the desired settings there.

 

Data protection for applications and in the application process

We collect and process personal data from applicants for the purpose of handling the application process. The processing can take place on paper or electronically by email or by filling out a web form. If an employment contract is concluded with an applicant, the personal data received will be processed for the purpose of processing the employment relationship in compliance with the statutory provisions. Otherwise, the application documents will be deleted three months after the rejection, provided that deletion does not conflict with our legitimate interests, for example in connection with a burden of proof in the sense of equal treatment. If you have given your consent, we can also store application documents for a longer period of time in order to consider them for any later vacancies.

In principle, we only keep your personal data for as long as is necessary for the purposes for which it was collected in accordance with this data protection declaration. However, it may happen that we are legally obliged to store certain data for a longer period of time. In this case, we ensure that your personal data is treated in accordance with this data protection declaration over the entire period.

 

Your rights

(1) You have the right to request information from us at any time free of charge about the personal data we have stored about you, as well as its origin, recipients or categories of recipients to whom this personal data is passed on and the purpose of storage.

 

(2) You also have the right to request us to correct, delete or restrict the processing of your personal data at any time. You also have the right to data portability.

 

(3) You also have the right to object to the processing of your personal data by us at any time.

 

(4) If you have given us your consent to use personal data, you can revoke this at any time without giving reasons.

We maintain current technical measures to ensure data security, in particular to protect your personal data from risks during data transmission and from third parties gaining knowledge. These are adapted in accordance with the current state of the art.

For this purpose, changes to the data protection declaration will be published on our website. Therefore, please read the current version of this data protection declaration regularly. Subject to applicable law, any changes to the Privacy Policy will be effective when the updated Privacy Policy is posted.
